I cordially invite Hawk to seriously look into this situation. I am ready to provide all screenshots of the dispute from Paypal to him. After that if you think the OP violated the terms he should be banned and the post deleted.
 
Quite funny how the biggest liar (and scammer) calls me a liar.

I was never told that I would get a refund. On the contrary, I was accused of violating the terms by uploading Rapidleech. When I confronted support with the fact that I was told by online sales support that private Rapidleech was allowed, you admitted that private Rapidleech was allowed upto 100Gb.

As I drew the conclusion that you wouldn't refund me because of violation of the terms, I opened the dispute. Which actually is my full right. You even might wonder if such a clause in your terms might be considered blackmail (and legal) and limits the rights of your customer to open a dispute. It is Paypal who decides if a refund will be made, not you.

And please enlighten me about what I lied:

- about the dismal performance of your service
- the low and clueless support
- false accusations

You are clever to mention only extracts but you never mentioned that you opened a dispute.

PS To make your life even more miserable, I will open a dispute with Paypal.'Didn't I?

According to you Leaseweb should be banned at first from Paypal because they allow Adult content.

Another example how clueless you and your croonies are. Webthosting is the one who violates the terms of Paypal. Why would I be concerned with Leaseweb's Paypal (provided they even have one).

You even tried to threaten us by reporting to Paypal that we allow adult content on our servers.

Again, wrong word choice. I didn't threaten. I actually reported webthosting to Paypal. It is, according to Jay of Paypal, under investigation.


From Paypal's Accepted Use Policy:

'You may not use the PayPal service for activities that relate to:

(g) certain sexually oriented materials or services
You're providing a sexually oriented service.

it is just like jackels shouting


Even before I gave webthosting the benefit of the doubt and signed up to test your service, there were many complaints about webthosting.

After that if you think the OP violated the terms he should be banned and the post deleted.

Tip: Upon revision of your terms, you should add this clause:

'If you open a dispute with Paypal or threaten us in any other way, we will use the services of a hitman, hunt you down and kill you' :P

As you made every effort to erase all proof and closed my client area, perhaps you are able to answer the following question on Wjunction
(I asked this several times but you avoid and refuse to answer at all):

'When we 'signed' the contract for a Photon Pro account it came with unlimited bandwidth and unlimited storage.

Then during the contract the quotas were limited to 250Gb and 15Gb respectively without prior notice and approval by myself (the client).

Wouldn't that be considered 'breaking the contract' and wouldn't you be liable to pay damages in a Court of Law?

I still would think that the odds are against you and hope to see that Hawk cleans the forum of your scamming practices.

I would like to see the screenshots of the disputed payment (along with the date, obviously) and anything else which you can provide.

The case is closed by Paypal.

From their email:

'Your seller has chosen to escalate this dispute to a PayPal claim. By
ending communication with you and escalating to a claim, the seller is
asking PayPal to investigate the case and decide the outcome. As part of
our investigation, PayPal reviewed any communication you may have had in
the Resolution Center.

Our investigation into your claim is complete. As stated in our User
Agreement, the claims process only applies to the shipment of goods. It
does not apply to complaints about the attributes or quality of goods
received. Therefore, we are unable to reverse this transaction or issue a
refund. '

Your seller has chosen to escalate this dispute to a PayPal claim.

How can that be ... what claim does Bentink have?

Anyway, the case is closed without honoring his claim or giving me a refund.

Reply to Paypal from webthosting:

'1. You were on a Leaseweb server (www.leaseweb.com), according to you Leaseweb should be banned from Paypal first because they allow legal adult content on their servers.2. We sell web hosting service, and not adult content.3. You violated our terms you accepted when you signed up for web hosting service and there is no refund for violating the terms.To Paypal: If you need proof please contact us.'

It's silly (I would even say stupid) to hide behind Leaseweb. I (and the others) have a contract with you.

You are the one who's offering adult hosting which is against Paypal's terms. We will see the outcome of that.

As said, I don't really care about 8 dollars and if it's refunded or not. I have enough satisfaction by having others understand that you're a scammer and liar.

Bentink, perhaps you saw this on the dispute:

The seller's account privileges will be limited if excessive complaints are received.

Fellow members, if you're able to make a dispute, I would encourage you to do so. Maybe Paypal will help us to get rid of Bentink or webthosting.

Furthmore, I am more and more inclined to believe that Bentink doesn't scam on purpose .. there's just something wrong with his brain.:))

If I were Bentink, I would have apologized for breaking the contract and refunded the full amount without escalation.

It's now (and will in the future) costing him much more than 8 dollars.

Using terabytes of bandwidth paying only $5 is not fair. We did not say you anything for long but that does not imply you can use terabytes of bandwidth at $5. At first you violated our terms by using your hosting account only for hosting files.

Recently there was a huge downtime from users using terabytes of bandwidth, so everyone had to be limited.

If you get terabytes of bandwidth at some other place at $5 please move there instead of complaining here, if you have any account credit left just open a ticket and you ill get 100% refund of the balance.

There was a $7.95 monthly plan. If you did not pay your invoice in time your account will be suspended and and there will be a late fee of $10, so total $17.95

If you do not pay all due invoices we will not unsuspend your account. Hope that clears everything.

We never asked someone $17 just for providing a backup.

to the rules.

The no refund on dispute was not made after you opened a dispute, it was there long back.

I will repeat we following our terms, we did not scam you. If you did not read the terms when signing up it is your fault.

Also as committed by us we also made a video tutorial for you when you said cpanel takes 3 minutes to load.

All your tickets had an average response time of less than an hour be it day or night.

We do not sell adult content, we sell web hosting.
