Could you locate the Vosges forests on a map of France? Well, the RIAA, the American music industry association, a pioneer in the fight against piracy, knows exactly where they are. The fault lies with Yohan Tordjman, a 35-year-old small Vosges entrepreneur, who has been on the blacklist of the American body based in Washington since October 2014. The reason ? He is the boss of 1fichier.com, a website which is part of the very controversial family of online file hosts.
Basically, these sites are used to legally store your videos, music and documents on the Web. But 1fichier.com, uptobox.com, rapidgator.net, and the others are mainly used as platforms where hundreds of thousands of fraudulent files pass through. “I don’t understand why the RIAA singled me out,” says the host. I tried to ask them the question by email, they never answered me. It's very annoying to be on this list, because I can no longer develop my company; All it takes is for a partner to see my name there for them to run away as if I had a criminal record. »
13.2 million French people hack
It must be said that illegal downloading has rarely done so well. A few weeks ago, for example, even before the first broadcast of season 5 of the medieval-fantasy series Game of Thrones, four episodes of the saga were illegally posted online on hosting providers. The process is classic: Internet users, distributor employees or unscrupulous journalists post the entirety of a film, a song or an episode of a series on a hosting site. Immediately, hundreds of thousands of smart people can download it, without authorization. A few weeks ago, it was very easy to obtain the film Fifty Shades of Gray, in excellent quality, even though it had not yet been released on DVD. According to a study carried out last year by the Association for the Fight against Audiovisual Piracy (Alpa) and Médiamétrie, 13.2 million French people consult at least one illegal download or streaming site every month (where you can watch online).
In January 2012, the FBI shut down the American illegal file host Megaupload. “I have nothing to hide,” assures Yohan Tordjman. Indeed, the law plays in favor of this former close friend of Xavier Niel, the boss of Free. A file host is not considered responsible for the content that is posted on its site since it is not supposed to dig into the personal data of its customers. “Even if I am aware of the abuses, you must understand that I am like La Poste, which is not responsible for what is found in the letters and packages,” comments the entrepreneur. What people store on my site is none of my business. How do you expect me to check everything? There are over 10 million files stored. » Its only obligation: respond to requests from “rights holders”, the legal owners of pirated videos, music and software. “If they report a file to me, I have to delete it. I eliminate around 1,000 per day, specifies the boss. If I don't do it, I risk prison. »
A real legal blur
So, no risk for Yohan Tordjman, who plans to expand his company by soon hiring five other employees? Not sure… In addition to appearing on the RIAA list, 1fichier.com is also observed by Hadopi (High Authority for the Dissemination of Works and the Protection of Rights on the Internet), in France. A survey carried out between February and May 2013 dissects the content present on the site. “I’m not sure that their study is very legal,” wonders Yohan Tordjman. If they attack me, I know what to say and what to do. Hadopi doesn't scare me. »
Rights holders are also starting to have enough of what they describe as “organized theft”. Last April, the American channel HBO commissioned a company specializing in the detection of IP addresses (the identity card of your computer), to find Internet users who illegally downloaded new episodes of its flagship series, Game of Thrones... ¦ Faced with the avalanche of illegal files posted every day on the Internet, I'm not sure that this will be enough to alleviate this new cold war.
