If he used valid information on the domain details then he will get them back. If not then he can even sue Name.com. Most of you don't know that this once happened to me 2, only I got 3 domains stolen and the person who did it transfered them to 2 other registrars. One of them was name.com. I spend day after day calling them, and the guy I was talking with was a really cool guy. These processes take time. Have them investigate the access log (with IP's) and such. Scan and send them your ID, drivers license, credit card statement, ANYTHING that proves that you were the legit owner of the domain.
