You'll never be completely safe.
But if you dont host in the US, then generally, you'll be fine, and the worst that will happen is your site gets shut down.

Most of webhosts, small ones, accept warez on US servers just to make a few bucks. for a few bucks they accept everything. But if they say, for example on live chat: "yes. we accept warez linking" and their TOS doesn't, better go away.
