Should a refund be given? In your opinion

Well nearly every day lately I'm having people sign up to my site pay for hosting and then want me to install unlicensed copies of Windows or other illegally accuired software.
This has made me and the data centre I use request licence agreements and in which I have been informing customers of late. And in the invoices I send out it states all sales are final and in the TOS that there are no refunds. (Due to the out of pocket expenses I will have to cover)
I have had another and this is the first one that has actually requested a refund.
And even supplied me with a key for windows 08 server that is readily available on google.

Your opinions?

I didn't get it clearly what you implied however I understand you are trying to say you have a customer who got a dedicated server from you and gave you a pirated windows 08 key to be installed on your servers which the server company does not consent to and now the customer is requesting a refund.


What you could do thus is, ask the datacenter to introduce a 30 days free key or give them a trial key which they can install and then after that you can use your customers key. If the datacenter receives complaints about the pirated keys, they have the right to suspend the server but till then it would be alright to use it else just continue with a trial copy

About the refund:


It your TOS mentions no refund, you do not have to refund the client especially for not allowing him to use a pirated key. You can obviously bend your TOS and grant him a refund but do it only in genuine cases or where its really needed. E.g You were not able to deliver the server up to the par.


You didn't do anything wrong by denying him a refund. You can give him a refund only if your business can bear the cost of it or you can resale it.
 
Lol..you created thread for this..i simply ask for trial windows..which is given by DC...also you didn't order the server yet...bcuz i pay the amount some 1 hrs ago....i need windows, that why i ask...but your unable to provide so i'll move to VPS provider.

Did i do something wrong??

This is my mistake i go with you..i've to better purchase from DC directly...instead of new provider.Who first talk to you like friend after you pay they simply make fool you.
I read your TOS...you told me that it takes 24-36 hrs to setup the server.

Well, i have given him the option to purchase the windows 2008 web edition licence for 15euro but he blatently refused, and its the datacentres policy about the pirated keys and needing licence agreements if there is a windows order coming in.

i have already asked them in the past about the trial keys and they told me it was abused in the past (people getting a server for 30 days, cancelling it and getting another server with another trial version) so they stopped doing it
 
SO atleast you've to told me that you can't give me even trial windows...then i'll never pay you.

Also refunding a customer you've to ask opinion from the other users??
 
you do know as soon as i recieved payment the order was made. so how would you know.. it does take less then 1 hour to order a server, in some of cases takes less then 15 seconds to get a dedicated server.

i already told you via skype that i could not give you trial windows. i have the messages here if you want a screenshot in case you have forgotten

Yes windows is avaliable with this server, but you must send the licence agreement prior to setup for windows

As you can see above in a PM i sent you yesterday, There must be a licence agreement prior to the windows setup.
i ordered as soon as you paid.
informed them that there will be a licence agreement sent over, as you said you owned a suitable licence.

and on been told you didnt have a suitable licence, i gave you the option to purchase one at 15 eur

When i'll get the server?? As you order already [as you mention]

Also Can you tell me, when customer ask for windows which you are not providing how can you proceed the order??

Yes i can get them to install Debian instead, 6 or 7?
24-36 hours from time of order.
and the other question in which you have already asked on skype has been answered on skype.
but for the sake of it i will answer it here too.

Server has to be built first, thus there is time from order to delivery to change the OS.
if i tell them that i want windows put on they can wait until the server is ready for the OS to be installed for the key and agreement.
so i can easily inform them to put a different OS on as it is before the time in which they put the OS on.
