Yes, flash is correct, but i ask the client before hand if he wants a vector for the icons. As the custom vector cost is pretty high( i have made many of them myself too when the client insisted), most of them don't have problem with the taking off the icons from free icon websites.Most of my icons are from sites like http://findicons.com/ etc. I wouldn't call it ripping at all.
and here you go for the psd proof(If you can find even 1 of these psd online i will happily accept that i did something wrong:
http://imgclub.org/images/untitlctc.png (it is much more detailed than that..just had to close the groups from screenshot point of view and yes i accept that i saw that design and liked the header idea so i tried to make it like that but nothing is ripped in it. it is created from the scratch so that's why if u compare the exact pixels and gradients, all will come to be different.

about wallbase, here is their current layout,

i dont see any similiarty :| and their previous layout just had that menu gradient which you are talking about WHICH was explained in tutorial and has been used by many websites.Apart from that title, my layout is completely different.

That facebook redesign thing, even i was amazed but nitish gave me that theme to code and i can vouch for him. While coding i saw all the gradients and drop shadows were there..and nothing looked ripped at ALL! only the icons were directly placed.Rest of the things had proper properties with them and seriously guys chill....

What Shadow meant, if im not mistaken, is not layer ripping but overall ripping how the design looks but just changing a few things.

You can clearly see a similarity but you stated as well that you saw the design and while it inspired you, keep in mind that even though you didn't rip any layers via the PSD, copying the physical aspect of a web design is still considered ripping which is what shadow was pointing out, again if im not mistaken. It's ok to get ideas out of other web designs as I do that myself, but try not to design it looking exactly like the original. Its like if I re-design WJ's theme and try to sell it, while I didn't have the PSD, I still copied a design hence calling it a rip. What gave it away I must say would have to have been the sides, plus on the right hand side you kept it the same as the original and the button on the header is the same. My two cents.
 
exactly, i think the side bars are making it really the same..but flash, you too must have seen that shadow effect in very many sites. its a common effect these days. I wanted to have that effect in my site.For example, see this:

jonaska's design. it is such a common design and this layout has been repeated so many times by so many designers..I wouldn't call that ripping. Its just that it was me this time.But i accept that it was my mistake taking that much similarity into my design for which i am suffering this thing and i am sorry for that.. but the other 2 claims were really baseless..
 
Right ok flash has got it spot on im not saying you are ripping directly but you are cloning other people work and making money off it which is my view is just as bad

I design stuff myself and i understand that sometimes you need alittle inspiration but this is more than that this is ripping even if you did it from scratch your still copying someone else's hard work

Yes you are right those show effects are common but keep in mind you kept it the same as the original with other things kept in tact as well :P When designing a template, you can copy someone elses idea (persay) but make it your own, copy that idea but change it to make it unique and not look like the original. Many designers do it trust me, I've worked with many but they take that concept and make it their own. Just work on that and you should be good (y)
 
I agree with flash.. Probably Nitish's inspiration from the theme @ deviantArt has to be accounted for the similarity. As far as the buttons are concerned, since they were available for use in any project (Free Stock Icons) Nitish gets a clean chit there.. Its upto him how he designs the input form with the stock icon..

i would just like to say that Nitish is a great guy to work with,
he was very helpful through out the entire process of creating
the theme that i wanted and the end product was amazing!

He spent in total about 1 entire week creating my unique template
for which he didn't ask much, i personally think its a bargain to
have someone create a unique template and spend so much time going
through with you step by step on how they are making it and he
also listens to every bit of input that i gave him and worked on
trying to imply it to the template!

This service of his is really great and a Bargain!

Theire is a 1.000.000 themes on the internet they cant be all different must be a simular i dont count nitish as ripper he is great designer!
