Friends Got Fined By Downloading!!

Yes sir you heard the statement. As you all may know we all use file hosts EVERYDAY. Rapidshare, MegaUpload, FileServe, FileSonic, HotFile, etc.
Well we all say its safe since we use HTTP and its impossible to track down. Well guess what, its not.

Today my friend who is a games/movies downloader got a Cease and Decist (Almost like a DMCA Complaint) letter. I laughed my ass off thinking its fake, turns out, its real. Yep we got a lawyer to find that out. He has to pay $1500 in fines for downloading MegaMind.

And its not just him. One of my friends has gotten a letter from his ISP about downloading Fighter, but they aren't charging him.


I bet your thinking "Oh wait, dumbass used a public tracker on torrents. noob".

Nope, he used HOTFILE. I know its fucked up. They are fucking tracking down people using HTTP downloads!! First torrents, now this??

Best bet is to get a PRIVATE TORRENT TRACKER and then do your downloading!!

This is not a lie, its 100%!!!

Btw we live in the US!

He probably used a public tracker for something else.
They started to track him, saw he downloaded other shit like MegaMind.
Fine him for that instead, to make you think that they are tracking HTTP downloads as well.

Another theory is that your dumbass friend got infected with the malware app those anti-piracy companies are spreading which monitor your PC for illegal downloads, they see a few. Choose one. Since he's in their jurisdiction and they feel that they can pursue, they do.

IF This is true, then it means Hotfile keeps logs of the files downloaded, unlike rapidshare (unless they changed it, they defently never used to) and i dont know about fileserve etc.

IF you can prove this to be true, i think people should boycott hotfile, it has always been possible for uploaders to be tracked as their ip is on the account but now hotfile is logging downloaders and handing over the logs, this is ridiculous, they will do the same to uploaders aswell.

FileServe and FileSonic pay around the same,(for all you who upload for money) and if they do not log downloaders, it will be best for everyone, if everyone switches.

IF you can scan the latter, black out the personal information and post it, it will add credability to your accusations.

Tracking is one thing, but If you track a connection, you still can't see what he's transfering right? I believe only with the first few bytes you can see the filename, Or did they use MD5 to identify a certain file?

Bro yep I was going to, but the lawyer has that form now. It won't be until he pays the fine in court and shit that he will get that letter back so I can scan it.

That was the first thing that came to my mind, that if I don't show proof, people won't believe me.

It is not illegal to download from third parties like HOTFILE. Even in the US.
Hotfile is responsible for deleting copyrighted files. Not deleted? Not reported! Not copyrighted.
I would get your lawyer to do that and contact Hotfile ltd and get them to clarify this..

Thank you for the confirmation. The sentence structure you used in the first post (Thread) was bit fishy. I made a script that scans a post for keywords that people in the United States rarely use and replies with (You are not from the United States, am I right?) or if there was a phrase that goes something like (We are from the US, I am from the US, etc) then it replies with (Your grammar doesn't sound like you are from the United States. k?, Lies, you are not from the US).

I am sorry for the misunderstanding and I will correct my script to avoid this specific problem in the future.

Yeah true, sharing (uploading) is illegal, but downloading is not sharing, well at least not in my dictionary!<_<

And yeh as of right now I am using a VPN and shit.


Its weird though, both had the same ISP. Luckily I have a diff ISP. Not much of a difference but my second friend did get a letter from his ISP so yeh.

But i thought you said you had TWO freinds, who both recived similar letters... the one who is not being charged surely is not going to a lawyer so you can atleast post his (after removing his details).

Yeh one who got one from the ISP as stated in the first post. The other one was the one who got the fine.
 
There's no way anti-piracy groups can find out who downloaded what with HTTP. Sure torrents make sense since your in a tracker which lists everyone's IP. The only problem is some if not all ISPs log everything in the USA for government purposes. So you see it's the ISP who's routing him out. Certain cable companies such as "SuddenLink" will disconnect your service and fine you if your caught pirating.
 
Haha.

Glad I live in New Zealand, last anti-piracy (well, ISP monitoring) laws caused some protests which made it get shot down.
