service is bad so far but if you are not premium after 215 downloads they delete your files for reaching max downloads. (AND ALSO CLAIM A DMCA TAKEDOWN.)

you know some will send a DMCA claim against even the most legit files--you should be able to do a counter DMCA for each claim, right?
 
Exactly ! Illegal software, illegal porn and pirated music will not be tolerated.
We really don't scam anybody. We pay our uploaders , we proved ourselves already and we will keep posting payment proofs.
And as for counter DMCA matter - those files we are talking about are mostly illegal, about 90% of them.

On a brighter note, we really consider improving our design. A new theme will be coming soon.

hmm well this host deletes your files if they are passworded. so I think no dice here.

ALso no way to counter a DMCA take down. 90% of my dmca reports are from rival uploaders who just want to make money.

If we cannot counter the claim then it is not a real DMCA claim, how can this host tell what is actually infringing and what a rival uploader, trying to corner the market on the same files I share?

I would like to see these so called DMCA reports because being a web admin myself I do deal with DMCA takedowns, 1000s have been filed but guess what? They were what is called "malformed" meaning not proper DMCA takedowns, and not legal. I removed 2 total articles from my website because they were legal takedowns.

These hosts should force those that claim they want stuff taken down, to write the proper paperwork and not to take down stuff unless they adhear to proper rules. (this would keep most uploaders from reporting rival uploads).

I am betting that all you need to take down a file is to send these guys an email with a list:

and claim they are the owner of it.

interesting they can claim ownership of a file after it has been posted on a site for 15 minutes.

seems that we cannot counter dmca take downs so this yes is a scam.

Like I said rival uploaders are responsible for 90% of my takedowns.

hey these files I do not like, please remove them for me I do not wish to give you any assurance that I am the owner of these files or own any rights to them but just take them down because I am going to upload them again myself and want to make some money.

Section 512(c)(3), which is referred to in the DMCA, continues by providing a list of six different elements which each letter must contain to be legally valid. While that goes a long way to clarifying the elements required of such a notice, it can be difficult to figure out how to meet the requirements adequately in a short letter. However, once you pierce through the legalese, the requirements are actually very simple.

The Required Elements

According to Section 512(c)(3), the required elements of a DMCA notice are as follows:

(i)A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

(ii)Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. ( a DMCA take down for EACH link [not filename] that they feel is infringing)

not likely that there was 15 takedown notices for 15 different files uploaded at different times and some not even posted in public

seems they understand me now so I have edited my post so as not to seem so hostile

question to zurby:

how can you assure that the complaints are from the rights holders and not from rival uploaders trying to cash in? Did you personally call the complaint holders?

It's not a big deal to check. We get e-mail and right after calls from companies. The ugliest case that almost got us into big trouble was one with some pedophile porn. We we're e-mailed and called. I will post our complaints so i can close everybody;s mouths!
I just need to get my hands on them.
