i need to know something about copyright......

suppose if a person creates a website @ weeblydotcom (free webhost) say with the name XYZ.weeblydotcom and after a few months another person creates his blog XYZ.blogspotdotcom without knowing that xyz.weeblydotcom is created previously , does it mean copyright infringement????

NOTE : The content of both the blogs are entirely different..unfortunately only the title is same

As far as i know both weebly and blogspot users do not have any copyright facilities.....but i need your answers....

If the content is completely different and for whatever reason this got taken to court I believe you would get away with it because you aren't actually copying anything of theirs and it was a mere coincidence that your company had the same name.

I'm no law expert but that's what I'd assume.

are u sure??? some lunatic weebly user sent me a mail saying i am infringing his copyright....

however i have another doubt...if there is XYZ.com and another person creates XYZ.blogspot.com or xyz.weebly.com, then does it mean copyright infringement????

Are you talking about domain name or the site content? I'm kinda confused. :))

Them haters just mad you going to take over their traffic :D

Like others said as long as theres no trademark you arent violating anything, You can register wjunction.co.uk,wjunction.me,wjunction.do,wjunction.to or w.e you want and it will be ok since WJ cant do anything about that since they arent a registered trademark

I answered your question already, if 'XYZ' isn't a trademark name then there is no copyright infringement as no one owns that name legally.

thanks for the quick answer guys....aah i just love this forum for this....

You can't hold copyright in a domain name. If he owns a trademark with a similar name or device, then there might have a case.
