you can say duplicate of this site just do some modification like changing color, some text and all.
When he will check my site then is he is able to take legal action against me or not ?

Yes, it could be possible that you will receive the DMCA complaint, if some one launched complaint against your web hosting content therefore its always better to register the content first ....you can also refer the following URL for further explanation
