identity are kept private and secure, whatever the circumstances. Benelux Servers also offers private offshore hosting
in Bucharest, Romania in the Voxility data centre.
Romania is known for its good freedom of speech laws and a popular choice for offshore hosting of controversial content.


Privacy


Benelux Servers takes privacy of our clients very seriously, we never monitor or check the contents of our clients' servers unless a violation of our terms and conditions is brought to our attention.
We also never disclose information to any third party whatever the circumstances in compliance with the data protection laws of Luxembourg and Romania.


We maintain minimum logs of our clients, the only logs we maintain are temporary payment logs needed for security which are deleted within 24 hours.

We have a flexible DMCA policy.

Yes. However, managed means full support. We didn't wanted to create two different pages. We thought seperate pages are useless. So we added an extra configuration. You can choose whether you prefer a self-managed server or managed, we've got you covered. All plans are self-managed by default but if you want you can change it to managed by choosing managed option while ordering.

Managed plans are including one cPanel license. You can get your cPanel license up on request. Your license will be available only on our servers.

Correct me if I'm wrong, but we never monitor or check the contents of our clients servers and Flexible DMCA policy can't stand together in any way.

If you never monitor content on client's servers, than that means you're unable to comply with any type of copyright infringement notice without proper warrant/court order (DMCA, Europeans etc). So I would suggest you to do the modification of your advertising plan, because false advertising is something that most of us don't like.

All illegal activities are strictly prohibited on all of our services

Examples of prohibited material on all Shared/Reseller, VPS/Dedicated Hosting plans:

*Financial Frauds/Scams
*Malicious bots
*Botnets
*Mail bombers, spam Scripts, mass mailers ARE STRICTLY FORBIDDEN! Sending spam could lead to a permanent ban of your account and you will be reported to the appropriate spam authority such as Spamhaus.
*Scam, Fraudulent Sites
*IP Spoofing, Making DDoS attacks, Hacking
*Child Porn
*Hosting of copyrighted material

So could you please explain to us how you're able legally to check for "illegal content" on customer's server, when you've legally obligated not to access any customer's data? Therefore, you're not able to comply with DMCA and other copyright infringement emails, but you're only able to pass/forward them to the client and pray to God that he will comply to it, because at all, the server/VPS node is leased under your business name, so you will be facing charges if it ever comes to that.


In one sentence - You have given legally full privacy to customer, so suspending customer's service or terminating it will be illegal and you can face with legal charges if customer decide to sue you.

I suggest you to find a proper lawyer who will write a quality legal documents, instead of trying to become one and write on it's own.

Under our terms and conditions we are not obliged to check or to monitor the data of our customers' servers unless they specifically engage in one or more of the given prohibited activities and it is brought to our attention through a complaint for example. If we are to receive a DMCA complaint or any other form of complaint, we will forward this to the client. If no action is taken within 24 hours we will address the issue and temporarily suspend the node and remove the infringing material and then we will reactivate the service as normal as we are not a "bullet proof" host. We aim to collect minimal information on our customers and aim to secure their privacy as best as we can in accordance with the data protection laws of Luxembourg.

We are due to introduce a new policy sometime soon, we hope that our terms of service has not caused you any inconveniences.

Unfortunately, the things you've just said are inaccurate, because you're legally obligated NOT to monitor user's content, brought to your attention or not.

Reason for that? Simply, Privacy Policy. Something you do or do not know is that Privacy Policy is legal document, same as Terms of Service and applicable same as Terms of Service. You've stated that you NEVER monitor or check content on server. Once you do, you have violated customer's privacy and that's reason for legal case. How's that? Because you're not allowed by your own document to suspend your customer even if he had content that violates Terms of Service, because you're not allowed to check his data.

So your statement from previous post is obviously wrong.

Also, one more thing wrong here is that you're (in case of email and no action taken by customer) violating his basic privacy by removing data that belongs to him. I suggest you to re-write your legal documents ;)
